APPEAL HEARING FOR REGINALD HAILE (Continuation of Hearing) Dan Scheurmann, attorney for Reginald Haile, has asked for a continuation due to the death of his father. ; Board agreed to continue this hearing. Daryl Edgens made a motion to add an item to the agenda to discuss the approval of applications. This motion was seconded by Lyle Johnson. Motion approved unanimously. Traditionally, one Board member has been approving application for examinations. Daryl Edgens asked for a legal opinion as to whether this was appropriate. David Hamilton has issued a written opinion on this. Requirements are set out by the classification requirements. As long as the objective criteria has been met, there is basically no question as to whether or not they are allowed to take the examination. If they do not submit all the paperwork, then they have submitted an incomplete application and it is rejected as incomplete. If they submit an application past the deadline, it is rejected as not being filed timely. If there is a question on whether or not it should be rejected, then it should be brought before the Board to review. There was an objection by a public spectator, Mr. Rushing, about when a competitive exam can be requested. His contention was the Board could only call for a competitive exam when either the list expires, all the people on the list have turned down the promotion, or the list has been expunged. Only then, can the Chief request an exam. 3 David Hamilton stated that he needs to request that this item be put on the agenda for an open meeting. Then the Board can discuss this further. Board agreed to have this item put on the November 16" agenda. Henry Clark made a motion to adjourn the meeting and Cynthia Wilkinson seconded this motion. Motion approved unanimously.
