By written communication dated November 13, 2007 he was notified that he was being terminated for violation of Departmental Rules. Specifically the following, WPDR 12-2 Article 26 Personal Conduct, WPDR 12-5 Dissemination of Documentation, and WPDR 12-10 section Ill Unsatisfactory performance, and WPDR 12-2 Truthfulness. Appellant filed timely appeal with 15 days of receipt of the written reasons for the disciplinary action. A public hearing was held at 6:00 P.M. on January 16, 2008 with the appellant present without counsel. The hearing was postponed till January 30, 2008 at 6:00 P.M. due to appointing authority's counsel being delayed at a federal trial. FINDING OF FACT 4, 412-2 Article 26 Personal Conduct - The board did hear evidence that this was substantiated. The Officer was involved in a traffic incident off duty, exited his vehicle, threatens the other driver, and used profanity. 2. 12-5 Dissemination of Documentation-The board did hear evidence that this was substantiated. The Officer ran his wives criminal history, and gave it to his divorce attorney. 3. 12-10 Section Ill Unsatisfactory performance - The board did hear evidence that this was substantiated. The Officer while on an 18 month disciplinary probation received several complaints against him and disciplinary action was taken. 4. 12-2 Truthfulness — The board did not hear evidence that this was substantiated. The officer was not intentionally untruthful about the facts surrounding the traffic incident. DECISION OF THE BOARD The evidence and testimony presented to the Board established that 12-2 Article 26 Personal Conduct, 12-5 Dissemination of Documentation, 12-10 section III Unsatisfactory Performance determines that the appointing authority did act in good faith and for cause in the disciplinary action taken against Officer Terry Braun and thereby upholds the action of the appointing authority. Furthermore, the board did not find evidence and testimony presented on 12-2 Truthfulness to establish any wrong doing on the Officers part. The Board determines that the appointing authority did not act in good faith and for cause in the disciplinary action taken against Officer Terry Braun and thereby does not upholds the action of the appointing authority. This was not a unanimous decision by the board. One board member did not vote this was Douglas Duke. All other members voted on all charges.
