By written communication dated May 9, 2013 he was notified that he was being suspended for one day for violation for Department Regulation 3-5, Article Ill - Operation of Department Vehicles. Appellant filed a timely appeal within 15 days of receipt of the written reasons for the disciplinary action alleging that the investigation was not completed timely. A public hearing was held at 5:30 PM on June 24, 2013. Police Officer Mark Tobin was present as a representative of the Kenner Police Department along with attorney Philip Boudousque’. Police Officer Gallagher was present without counsel. All parties were sworn in and the following witnesses testified: 1. Police Officer Patrick Gallagher 2.
